Terms of Sale

Highlights. These Terms of Sale govern your purchase of bumper-car event tickets from Kaboom Auto-Tamponneuse inc. (“Kaboom Montréal”) at https://www.kaboommontreal.com/. Tickets are digital and delivered instantly to your email once payment is confirmed. We do not ship physical goods. All sales are final: no refunds and no returns. However, if your scheduled session is affected by adverse weather, your ticket may be rescheduled at no additional cost. Payments are processed securely through WooCommerce with Global Payments. Prices are listed in Canadian dollars (CAD) and exclude applicable sales taxes, which are calculated at checkout. By completing a purchase, you agree to these Terms.

Scope

These Terms of Sale (“Terms”) apply to every purchase of tickets and related digital products offered on https://www.kaboommontreal.com/ (the “Website”) by Kaboom Auto-Tamponneuse inc., a corporation incorporated in the Province of Québec (“Kaboom Montréal”, “we”, “us”, or “our”). They form a binding contract between you (the “Customer”) and Kaboom Montréal. These Terms are read together with our Terms of Service (governing general use of the Website), our Privacy Policy, and our Cookie Policy.

Eligibility to Purchase

To purchase tickets, you must be at least 18 years of age or have the consent of a parent or legal guardian. By placing an order, you represent that the information you provide is accurate and that you have the legal capacity to enter into a binding contract under the laws of Québec.

Product & Service Descriptions

Kaboom Montréal sells admission tickets to bumper-car (“auto-tamponneuse”) experiences and related events. Each ticket grants the holder the right to attend a specific session at the date, time, and location indicated on the ticket, subject to availability, capacity limits, and on-site safety rules.

We make reasonable efforts to describe each experience accurately on the Website. Photographs, illustrations, and session descriptions are for informational purposes and may differ slightly from the on-site experience.

Digital Goods

Tickets are delivered electronically as digital goods. By completing your order, you expressly consent to the immediate provision and delivery of your ticket and acknowledge that, once the ticket has been delivered to your email address, your statutory right of withdrawal (where it would otherwise apply) is waived to the extent permitted by applicable law.

Pricing, Taxes & Currency

All prices are displayed in Canadian dollars (CAD) and exclude applicable sales taxes. Goods and Services Tax (GST) and Québec Sales Tax (QST), where applicable, are calculated and added at checkout. Prices may change without notice; the price applicable to your order is the price displayed at the time you submit it.

Order Process & Contract Formation

  1. You select the experience, date, and quantity of tickets and add them to your cart.
  2. You review the order summary, enter your billing and contact information, and submit payment.
  3. After successful payment, we display an on-screen confirmation and send an order-confirmation email containing your ticket(s).
  4. The sales contract is formed at the moment we send the order-confirmation email.

We reserve the right to refuse, cancel, or limit any order, including in cases of suspected fraud, error in pricing or availability, or violation of these Terms. If we cancel an order before delivery, the corresponding amount will be refunded to the original method of payment.

Payment Methods

Payments are processed through WooCommerce with Global Payments as the payment gateway. Accepted methods include major credit and debit cards supported by Global Payments. Payment information is transmitted directly to the payment processor over a secure connection; Kaboom Montréal does not store full card numbers on its servers.

Order Processing & Delivery

Because we sell digital tickets, no physical shipping is involved.

  • Order-processing time: instant, upon successful payment confirmation.
  • Delivery time: instant — tickets are sent by email to the address you provided at checkout, as soon as the payment is confirmed.

If you do not receive your ticket within a few minutes of payment, please check your spam or promotions folder and then contact us at support@kaboommontreal.com.

Risk of Loss & Title

Title to and responsibility for each ticket transfers to you upon delivery of the order-confirmation email containing the ticket. You are responsible for safeguarding your ticket and the QR code or unique identifier it contains. We are not responsible for tickets that are lost, stolen, deleted, forwarded, duplicated, or otherwise used without your authorization.

Returns, Exchanges & Refunds

All sales are final. Kaboom Montréal does not offer refunds or returns on tickets.

Bad-Weather Rescheduling

If a session is cancelled, shortened, or made unsafe by adverse weather conditions, you may, at no additional cost, reschedule your ticket to another available session of equal value. To request a reschedule, contact support@kaboommontreal.com with your order number before, or within a reasonable time after, the affected session. Rescheduling is subject to session availability.

No Exchanges

Tickets cannot be exchanged for cash, credit, other products, or services, except as expressly provided in the bad-weather rescheduling section above.

Limitation of Liability

To the maximum extent permitted by applicable law, the total aggregate liability of Kaboom Montréal arising out of or in connection with the sale of a ticket — whether based in contract, tort, statute, or otherwise — is limited to the purchase price actually paid by the Customer for the ticket giving rise to the claim. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the laws of Québec, including under the Consumer Protection Act (Québec).

Governing Law & Dispute Resolution

These Terms and any sales contract formed under them are governed by the laws in force in the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts sitting in the judicial district of the head office of Kaboom Montréal, Province of Québec, for the resolution of any dispute, subject to any mandatory consumer-protection rights you may have under Québec law.

Changes to These Terms

We may update these Terms from time to time. The version applicable to your purchase is the one in effect on the date your order is placed. The current version is always available on the Website, with the “Effective Date” updated accordingly.
